Welcome to Nudi Spray. These Terms & Conditions ("Terms") set out the rules for using our website at www.nudispray.com and the contract between us when you buy our products. Please read them carefully before placing an order or signing up to a subscription.

By using our website or placing an order, you confirm that you've read, understood and accept these Terms. If you don't accept them, please don't use the website or order from us.

These Terms are between you and HRT & ME Limited, a company registered in England and Wales with company number 14929279, whose registered office is at Judins, Heathfield Road, Burwash Weald, East Sussex, TN19 7LA. VAT number GB 472 7105 94. We trade as "Nudi Spray". In these Terms, "we", "us" and "our" mean HRT & ME Limited, and "you" and "your" mean the person using our website or placing an order.

1. Other documents that apply

These Terms should be read alongside the following, which form part of our agreement with you:

If anything in these Terms conflicts with one of the documents above, that other document takes priority on the specific point it covers (for example, the Subscription Terms govern subscription-specific issues).

2. Who can use our website and buy from us

To place an order or open an account, you must:

  • be at least 18 years old;
  • have a delivery address in the United Kingdom (we currently ship to UK addresses only);
  • be legally able to enter into a binding contract; and
  • use a valid payment method that you are authorised to use.

3. Your account

You don't have to create an account to browse our website, but you do need one to place orders or manage a subscription.

When you create an account, you must give us accurate, up-to-date information. Keep your password confidential and don't share your account with anyone else. You're responsible for everything that happens under your account. If you think someone has accessed your account without permission, please tell us straight away at hello@nudispray.com.

We may suspend or close an account if we reasonably believe it's being used in breach of these Terms or fraudulently.

4. How a contract is formed

When you place an order through our website, you're making an offer to buy. Our website will send you an order confirmation email, but this is just an acknowledgement that we've received your order – it is not yet acceptance.

A binding contract is formed only when we dispatch the goods to you (or, for subscription orders, when we dispatch your first delivery). At that point we'll send you a dispatch confirmation email.

If we can't accept your order – for example, because an item is out of stock, we can't authorise your payment, there's been an error in the price or description, or you don't meet the eligibility requirements in Section 2 – we'll let you know by email and won't charge you (or we'll refund any payment already taken).

5. Products

We do our best to describe and photograph our products accurately, but minor variations in colour, packaging and presentation can occur. The images on our website are for illustration; the product you receive may differ slightly.

Nudi Spray is a cosmetic skincare product designed to remove adhesive residue from skin. It is not a medical device, not a medicine, and not a substitute for medical advice. We make no medical claims for our products. If you have any concerns about your skin, your HRT treatment, or your menopause symptoms, please speak to your GP, pharmacist or another qualified healthcare professional.

If you have sensitive skin or known allergies, please check the ingredients list on the product or product page and patch-test before full use. Stop using the product and seek medical advice if you experience any adverse reaction.

6. Price and payment

Prices are shown on the product page in pounds sterling (GBP) and include VAT at the applicable rate. Delivery costs are shown separately at checkout.

We take reasonable care to make sure prices are correct. If we discover a pricing error before we accept your order, we'll contact you to ask whether you want to proceed at the correct price or cancel. If we discover a pricing error after we've accepted your order, and the error is obvious and could reasonably have been recognised by you as a mistake, we may cancel the order and refund you in full.

Payment is taken at the time you place your order. We accept the payment methods shown at checkout. Payments are processed by trusted third-party providers (such as Shopify Payments, Stripe, Apple Pay, Google Pay and Shop Pay). We don't store full card details on our own systems.

By submitting an order, you confirm that the payment details you've provided are yours (or that you've been authorised by the cardholder to use them).

7. Delivery

We ship orders within the United Kingdom using Royal Mail and other trusted carriers. Delivery options, costs and estimated timescales are set out on our Shipping & Delivery page.

Delivery times are estimates and we can't guarantee them, but if delivery is delayed beyond a reasonable period we'll work with you to resolve it. If you don't receive an order within 14 days of dispatch, please contact us at hello@nudispray.com.

Risk in the goods passes to you when they're delivered to the address you've given us. Title (ownership) passes to you when we've received payment in full.

8. Subscriptions

If you sign up to a Nudi Spray subscription, our Subscription Terms apply in addition to these Terms. Those terms cover renewals, pricing changes, pausing, skipping, cancelling and other subscription-specific issues.

9. Your right to cancel, returns and refunds

As a UK consumer, you have important statutory rights, including a 14-day "cooling-off" right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and rights in relation to faulty, damaged or incorrect goods under the Consumer Rights Act 2015.

We also offer a 30-day Satisfaction Guarantee on first orders, on a goodwill basis, in addition to your statutory rights.

Please note that, under regulation 28(3)(g) of the 2013 Regulations, the statutory cooling-off right does not apply to sealed products that are unsuitable for return for health protection or hygiene reasons once they have been unsealed. This means that once the seal on your Nudi Spray, Nudi Pads or Easi Pads has been broken, the statutory right to cancel that item under the cooling-off period no longer applies. Our separate 30-day Satisfaction Guarantee can still apply to first orders, even on opened products – see the Refund & Returns Policy.

Nothing in these Terms affects your statutory rights as a consumer.

10. Using our website

You can use our website to browse our products, place orders, manage your account, read our blog and contact us. You must not:

  • use the website in a way that breaks any law or regulation, or is fraudulent or unlawful;
  • introduce viruses, malware, or any other harmful code;
  • try to gain unauthorised access to our website, the server it runs on, or any connected database;
  • attack our website by means of a denial-of-service attack or otherwise;
  • scrape, copy, republish or reuse content from the website (including text, images and videos) for commercial purposes without our written permission;
  • use any automated system (bots, scrapers, crawlers) to access the website other than legitimate search-engine indexing;
  • impersonate any person or misrepresent your identity or affiliation; or
  • use the website to send unsolicited marketing or spam.

We reserve the right to suspend or terminate your access to the website if we reasonably believe you've breached these Terms.

11. Website availability

We aim to keep our website available and running smoothly, but we can't guarantee it will always be available or uninterrupted. From time to time we may suspend, withdraw or restrict access to all or part of the website for operational, maintenance or business reasons. We'll try to give reasonable notice where we can.

You're responsible for making sure that any device you use to access our website is compatible and secure.

12. Intellectual property

All content on our website – including text, graphics, logos, photographs, videos, the "Nudi Spray®" name and logo, product packaging designs, blog content and user interface design – is owned by us or our licensors and is protected by intellectual property laws.

You may view, download and print content from our website for your personal, non-commercial use. You must not otherwise copy, modify, distribute, publish, transmit, display, sell or use any of our content without our prior written permission.

"Nudi Spray" is a registered trade mark of HRT & ME Limited. You must not use our trade marks without our written permission.

If you submit a review, comment, photograph or other content to our website or social media accounts, you grant us a worldwide, royalty-free, non-exclusive licence to use, reproduce, edit and display that content in connection with our business (including for marketing purposes), and you confirm that you own or have the right to grant us that licence.

13. Reviews and testimonials

We welcome honest reviews of our products. By submitting a review you confirm that it reflects your genuine experience and opinion. We do not buy, fake, or solicit dishonest reviews, and we comply with the Digital Markets, Competition and Consumers Act 2024 and Competition and Markets Authority guidance on consumer reviews. Where a reviewer has received a free product, discount or other incentive in exchange for a review, this is disclosed.

14. Our liability to you

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of your statutory rights as a consumer; or (d) any other liability that cannot lawfully be excluded or limited.

Subject to the paragraph above:

  • We supply our products for domestic and private use only. We're not liable for any business losses (including loss of profits, loss of business, business interruption, or loss of business opportunity).
  • Our total liability to you in connection with any order is limited to the price you paid for that order.
  • We're not liable for any losses that aren't a foreseeable result of our breach of these Terms. Losses are foreseeable if they are an obvious consequence of our breach or were known to both of us at the time the contract was formed.

15. Events outside our control

We won't be liable for any failure or delay in performing our obligations under these Terms that is caused by events outside our reasonable control, such as severe weather, fire, flood, strikes, civil unrest, acts of war or terrorism, epidemic or pandemic, failure of public or private telecommunications networks, or default of suppliers or sub-contractors. If such an event occurs we'll contact you as soon as reasonably possible and work with you to minimise any disruption.

16. Privacy and cookies

Your privacy matters. Our Privacy Policy explains what personal data we collect, how we use it, who we share it with, how long we keep it, and your rights. Our Cookie Policy explains how we use cookies on our website.

17. Communications between us

When we refer to "writing" or "written" in these Terms, this includes email. You can contact us at hello@nudispray.com or by post at the address in Section 21. We'll contact you using the email address or postal address you've given us with your order or account.

18. Complaints and dispute resolution

If you have a complaint, please contact us at hello@nudispray.com in the first instance. We take complaints seriously and will do our best to resolve any issue quickly and fairly.

We don't currently subscribe to a specific Alternative Dispute Resolution (ADR) scheme, but you remain free to pursue your statutory rights and (if necessary) to bring proceedings in the courts.

19. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page tells you when they last changed. The version that applies to your order is the one in force on the date you placed the order. For significant changes (for example, changes to cancellation rights or pricing rules), we'll let existing customers know by email or by a clear notice on the website.

20. General

Whole agreement. These Terms, together with the other documents referred to in Section 1, set out the whole agreement between you and us in relation to your purchase. They replace any previous agreement or understanding between us.

If part of these Terms is invalid. If any part of these Terms is found to be unlawful or unenforceable, the rest will continue to apply.

If we don't enforce a term. If we don't immediately enforce a right under these Terms, that doesn't mean we've waived it – we can still enforce it later.

Transfer. We may transfer our rights and obligations under these Terms to another business (for example, in a sale of the company), but we'll always tell you in writing if this happens and your rights under these Terms won't be affected. You may only transfer your rights or obligations under these Terms to someone else if we agree in writing.

No third-party rights. These Terms are between you and us. No other person has any rights to enforce them under the Contracts (Rights of Third Parties) Act 1999.

21. Governing law and jurisdiction

These Terms, and any contract formed under them, are governed by the laws of England and Wales. Any dispute will be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
